About title insurance

Title insurance protects buyers and lenders against losses from title defects that existed before the policy was issued — undiscovered liens, forged deeds, missing heirs, fraudulent conveyances, and recording errors. Polo | Pimentel Law works with established Florida title insurance underwriters to issue owner's and lender's policies on the closings we handle.

Unlike a non-attorney title company, we bring legal analysis to the title search — surfacing issues that would not rise to the level of an exception in a title commitment but that still matter to you. When title defects are discovered, we either resolve them before closing or advise you clearly on the risk of proceeding.

If a title insurance claim arises after closing, we assist with claim preparation, negotiation with the insurer, and litigation where necessary.

Scope

What we handle

Owner's policies

Protects the buyer's ownership interest. Issued at the purchase price (or appraised value for non-sale issuance) with coverage extending as long as you or your heirs own the property.

Lender's policies

Required by most lenders. Protects the lender's lien position. Issued at the loan amount with coverage decreasing as the loan is paid down.

Title defect resolution

Old mortgages that were never satisfied, missing probate paperwork, boundary disputes, and recording errors — all resolved before closing.

Claims assistance

If a title issue is discovered after closing, we help you file and pursue the claim with the underwriter.
